Short version: we sell frozen Japanese Wagyu, one cow at a time, shipped from our cold storage to the 48 contiguous states and Washington, D.C. Orders have a $150 minimum, stock is limited to what that animal produced, and if your box arrives thawed or damaged, email us photos the day it's delivered and we'll take it up with the carrier. Overview
The terms "we", "us" and "our" refer to Peak Wagyu, LLC ("Peak Wagyu"). Peak Wagyu operates this store and website, including all related information, content, features, tools, products and services (the "Services"). Peak Wagyu is powered by Shopify, which enables us to provide the Services to you.
These terms, together with the policies they reference (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services. Please read them carefully: they include important information about your legal rights, including warranty disclaimers and limitations of liability.
By placing an order, you agree to these Terms, our Refund Policy, and our Shipping Policy, and acknowledge our Privacy Policy. By otherwise visiting, interacting with or using the Services, you also agree to these Terms. If you do not agree to them, you should not use or access the Services.
1. Access and Account
By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence.
To use the Services, including browsing our store or purchasing our products, you may be asked to provide certain information, such as your email address and your billing, payment, and shipping information. You represent and warrant that all the information you provide is correct, current and complete, and that you have all rights necessary to provide it.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.
2. Our Products
Our beef is a natural product. We sell the cuts of one animal at a time, and every cut is different: marbling, color, shape, and the exact weight of each pack vary from piece to piece and from photographs or descriptions on the Services. Pack weights are approximate. Colors may also look different on your screen depending on your device and its settings.
Our stock is limited to what each animal produced, and each drop is offered for a limited time. We may close a drop, discontinue any product, or limit the quantities we sell to any person or region at any time. Product descriptions may change at any time without notice.
3. Orders
When you place an order, you are making an offer to purchase. Our order confirmation email confirms that we received your order; we accept it when we ship it. Until then, we may decline or cancel all or part of your order for any reason. We must receive and process your payment before your order is accepted. Orders must meet our order minimum, shown in your cart and at checkout.
If, for any reason, we decline, cancel, or are unable to fulfill all or part of an order after you have paid for it, our sole obligation will be to refund the amount you paid for the unfulfilled portion. If we decline, change, or cancel an order, we will also try to notify you using the email address, billing address, or phone number you gave us when you ordered.
Please review your order carefully before submitting it. Because our products are perishable food, we cannot accept returns, and we may be unable to cancel an order once it has been picked at our warehouse. Cancellations, refunds, and orders that arrive damaged are covered by our Refund Policy.
Our products are sold as groceries: food for you to eat, serve, share, or give as a gift. You represent and warrant that your purchases are not for resale.
4. Prices and Billing
Prices, discounts and promotions may change without notice. Subject to Section 12, the price charged for a product will be the price in effect when the order is placed, as set out in your order confirmation email. Unless expressly stated otherwise, posted prices do not include taxes or shipping, which are calculated at checkout.
We may offer promotions that are governed by their own terms. If the terms of a promotion conflict with these Terms, the promotion's terms govern.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases, and to promptly update it so that we can complete your transactions and contact you as needed.
You represent and warrant that (i) the payment information you provide is true, correct, and complete, (ii) you are authorized to use that payment method for the purchase, (iii) charges incurred by you will be honored by your payment provider, and (iv) you will pay charges incurred by you at the posted prices, including shipping and all applicable taxes, if any.
5. Shipping and Delivery
We ship only to the 48 contiguous states and Washington, D.C., and we cannot deliver to PO boxes. Orders ship frozen, vacuum sealed, and packed with dry ice in an insulated box for their expected transit time. See our Shipping Policy for details.
Ship and delivery dates are estimates and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather, or other events outside our control. If we cannot ship your order by the date we gave you, we will tell you, and you may cancel for a full refund or accept the new date. You are responsible for providing a correct shipping address and for bringing your box inside and refrigerating or freezing its contents promptly after delivery. We are not responsible for spoilage caused by an incorrect address or by a box left unattended past the end of the day the carrier marked it delivered.
Title and risk of loss pass to you when we hand your order to the carrier. If your order arrives thawed or damaged, you must email us at moo@peakwagyu.com, with photos of the box and its contents, on the day it's delivered; if an item is missing or incorrect, you must email us within 3 days of delivery. Where it applies, we will file a claim with the carrier or our warehouse on your behalf. Any refund or replacement is handled as set out in our Refund Policy.
6. Food Handling and Dry Ice
Our products are raw meat. Keep them frozen or refrigerated, thaw them in the refrigerator, and cook them to the temperature you choose at your own discretion. Consuming raw or undercooked meat may increase your risk of foodborne illness. Once a product has left our care, we are not responsible for how it is stored, handled, or prepared.
Your box is packed with dry ice, which can burn skin and gives off carbon dioxide gas. Do not touch it with bare hands, eat it, or seal it in an airtight container, and let it sublimate in a well-ventilated area away from children and pets.
7. Intellectual Property
The Services, including all trademarks, brands, text, displays, images, graphics, video, and audio, and the design, selection, and arrangement thereof, are owned by Peak Wagyu, its affiliates or licensors and are protected by U.S. and foreign copyright, trademark, and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, or republish any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants you a license or other rights under any patent, trademark, copyright, or other intellectual property of Peak Wagyu, Shopify or any third party. All rights not expressly granted herein are reserved by Peak Wagyu.
Peak Wagyu's names, logos, product and service names, designs, and slogans are trademarks of Peak Wagyu or its affiliates or licensors. You must not use them without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.
8. Third-Party Tools and Links
The Services may include tools, materials and links provided or operated by third parties, which we do not monitor or control. We provide access to them "as is" and "as available", without any warranty or endorsement, and you use them at your own risk. We are not liable for any harm or damages related to your use of third-party tools or websites, or to any products, services, or content you obtain from them. Please review a third party's terms and policies before you engage in any transaction with them, and direct any questions or complaints about their products and services to them.
9. Relationship with Shopify
Peak Wagyu is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Peak Wagyu. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Peak Wagyu, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Peak Wagyu.
10. Privacy Policy
All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may be subject to the Shopify Consumer Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit to the Services will be transmitted to and shared with Shopify, as well as third parties that may be located in countries other than where you reside, in order to provide the Services to you. Our Privacy Policy describes how we, Shopify, and our partners use your personal information.
11. Feedback
If you submit, post, email, or otherwise send us any ideas, suggestions, feedback, reviews, photos, or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display that Feedback in any medium for any purpose, including commercial use, such as to operate, improve and promote the Services.
You represent and warrant that: (i) you own or have all necessary rights to your Feedback; (ii) you have disclosed any compensation or incentives you received in connection with it; and (iii) it complies with these Terms and does not violate any third party's rights. We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it, and we may, but are not obligated to, monitor, edit or remove Feedback that we determine in our sole discretion to be unlawful, objectionable, or in violation of these Terms. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or others as to the origin of any Feedback. You are solely responsible for your Feedback and its accuracy.
12. Errors, Inaccuracies and Omissions
Information on the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, weights, pricing, promotions, shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate, at any time and without prior notice, including after you have submitted your order. If we cancel an order for this reason, we will refund any payment you made for it.
13. Prohibited Uses
You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, federal, state or local law or regulation; (c) to infringe our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, defame, intimidate, or harm any of our employees or any other person; (e) to transmit false or misleading information; (f) to send spam or other unsolicited advertising; (g) to impersonate or attempt to impersonate any other person or entity; or (h) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm Peak Wagyu, Shopify or users of the Services, or expose them to liability.
In addition, you agree not to: (a) upload or transmit viruses or any other malicious code; (b) resell or commercially exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, or pretext the Services; (e) use automated means to access the Services other than as permitted in Agents below, or in a way that places an unreasonable load on them; or (f) interfere with, bypass, or circumvent the security or authorization features, robot exclusion headers, or other measures we use to restrict access to the Services. Our robot exclusion headers govern crawling and indexing; an Agent acting under Section 14 may use the cart and checkout to place an order for a person. We may suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.
14. Agents
14.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity, without direct supervision.
14.2 Agents are welcome to browse the Services, including the machine-readable versions we publish for them, and to place orders on behalf of a person. An Agent may do so only while it identifies itself and operates in strict accordance with section 14.4. No Agent may access, use, or interact with the Services if we have asked it to stop.
14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with the Services. You are responsible for every action an Agent takes on your behalf, including any order it places.
14.4 Agents must: (i) identify themselves as an Agent, by name, in their user agent string or through a recognized agent-identification method (such as signed requests under Web Bot Auth); (ii) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by (a) mimicking human behavior and interaction patterns, or (b) completing or circumventing CAPTCHAs or other measures intended to distinguish computer use from humans, and instead hand any such step to the person they act for; (iii) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer; and (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.
15. Termination
We may terminate these Terms or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
The following sections will continue to apply after any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.
16. Disclaimer of Warranties
Information on the Services, including cooking and handling guidance, is provided for general information purposes only. We do not warrant the accuracy, completeness, or usefulness of this information, and any reliance you place on it is strictly at your own risk.
EXCEPT AS EXPRESSLY STATED BY PEAK WAGYU, THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.
17. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL PEAK WAGYU, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THEM, EVEN IF ADVISED OF THEIR POSSIBILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT ORDER. NOTHING IN THESE TERMS LIMITS OR EXCLUDES LIABILITY FOR PERSONAL INJURY OR ANY OTHER LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.
18. Indemnification
You agree to indemnify, defend and hold harmless Peak Wagyu, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) the actions of any Agent acting on your behalf.
We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.
19. Severability
If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall still be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms without affecting the validity and enforceability of the remaining provisions.
20. Waiver; Entire Agreement
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
These Terms and any policies or operating rules we post on the Services constitute the entire agreement between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including any prior versions of these Terms). Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
21. Assignment
You may not delegate, transfer or assign these Terms or any of your rights or obligations under them without our prior written consent, and any such attempt will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.
22. Governing Law
These Terms, and any separate agreements under which we provide you Services, are governed by the laws of the State of Texas, without regard to its conflict of law rules. You and Peak Wagyu consent to the exclusive venue and personal jurisdiction of the state and federal courts located in Travis County, Texas, except that either of us may bring an individual claim in a small claims court in the county where you live, if the claim qualifies.

The headings used in these Terms are included for convenience only and will not limit or otherwise affect them.
24. Changes to These Terms
You can review the most current version of these Terms at any time on this page. We may update, change, or replace any part of these Terms by posting the changes on the Services and updating the "Last updated" date above. We will notify you of any material changes in accordance with applicable law, and such changes will be effective on the date specified in the notice. Your continued use of the Services after changes are posted constitutes acceptance of them. The Terms in effect when you place an order apply to that order.
